If a citizen were to hit a pedestrian, or wheel chair bound gentleman, in a crosswalk they would certainly be charged with reckless driving. The lack of charges for the Albemarle Police Officer involved is an obvious abuse of power. Such a menace should be charged, made to apologize and fired from the police force.
Look both ways when you cross the street, and if the police are nearby, you might consider waiting to cross until they are out of site.

Tim Longo is responsible for the ticket issued. If he doesn't name an officer than by default he is accepting responsibility.
John Miller also needs to go. He is extremely aloof and unresponsive. Channel 29 covered a story about how Albemarle County officers go to Eastside Speedway in Augusta County to practice driving. NBC29 never covered the story of the head on crash of an Albemarle County officer driving recklessly on HWY 340 in Augusta EN ROUTE to/from driving practice, in which a motorcycle rider was maimed.

"As Mitchell was being treated in the UVA emergency room, Charlottesville police officer Steve Grissom arrived with a ticket charging Mitchell with failure to obey a pedestrian signal. Mitchell says Grissom told him police had a video of him crossing while the pedestrian signal said "don't walk."

I have spoken with a County officer recently, and apparently the Albemarle County PD video cameras are only activated when the blue lights are on or when the officer actually turns the camera on.
I speculate they were hoping to get a statement from Mr. Mitchel admitting fault.
Based on the statements of witnesses, a car stopped early on yellow and waved Mitchell in to the intersection. By default, the county officer would still have a red light at the time Mitchell entered the crosswalk.
It is nice to hear Mayor Brown is willing to get involved: "I'm not happy with the situation, but I'd like to hear all sides before I decide what should be done," he says.
when will these people learn that "we decline to comment" means "screw you we are not accountable"
the real problem is that the city council is made up of to few people wiling to throw down and FIX things. Kevin lynch has shown a lot of gumption but he couldn't do it alone.

Yes, Albemarle County Police Officer Gregory C. Davis and his callous assault on Gerry Mitchell needs to be brought to justice. Back in olden times you would just tar and feather the idiot. With an ever growing population you have to be patient and wait for a formal process to bring justice to the felonious crosswalk criminal.
The officer that actually hit Mr. Mitchell is not the real problem. He apparently did apologize on the spot. He is only mistake was bad driving.
When the leadership of the police department got involved, that's when it got ugly. It's supposed to be the other way aroung, cop makes a mistake, and the leadership corrects things. (as opposed to covers up).
Obviously there is a problem with the leadership of the departments involved.
With Longo not saying who ordered the ticket, by default HE (Longo himself) is the responisble party. And Dave Chapman (Charlottesville Commonwesth's Attorney) is also responsible if his office prosecutes a bogus case. There is a complaint process with the Virginia State Bar which has teeth in regards to punishing rogue attorneys.
If Chief Longo can't sort this out, he needs to go. If City Council won't replace him, they need to go. If voters keep electing spineless, distracted city coucilors, well, they get what they deserve. A cute looking little town with Art in Place and traffic calming, but no justice and no affordable housing for those at the "bottom" of the income levels.
Excuse me, Vic. But the democrats keep electing these people.

Vic, I believe the reason for the motorcycle accident was the officer was playing with his gadgets (XM radio) in his cruiser and crossed the centerline. I wonder why that was not news worthy??? Did the officer get charged with wreckless driving I wonder? What was Greenwood playing with when she struck & killed the pedestrian on Rio road? If the victim was a US citizen you can be sure this would not have quietly go away.
